By accessing or using GPT-HQ ("the Platform," "we," "us," or "our") at gpt-hq.com, creating an account, or making or receiving a purchase, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all visitors, buyers, sellers, and anyone else who accesses or uses the Platform.
GPT-HQ is an online marketplace where independent sellers list and sell AI-related digital products including but not limited to custom GPT configurations, prompt templates, AI workflows, automation tools, and other AI-powered utilities. GPT-HQ acts solely as a platform facilitating transactions between buyers and sellers; we are not a party to the sale itself unless expressly stated.

As a buyer on GPT-HQ you agree to:
All sales of digital products are generally final. Refunds may be issued at our discretion in cases of non-delivery, material misrepresentation, or fraud. Contact support@gpt-hq.com within 14 days of purchase to request a refund.
As a seller on GPT-HQ you agree to:
GPT-HQ reserves the right to remove any listing, withhold payouts, or suspend seller accounts for violations of these Terms or our content policies. Sellers are solely responsible for the legality and quality of their products.
You may not use GPT-HQ to list, sell, or distribute:
You may not engage in scraping, reverse engineering, automated abuse, spam, or any activity that interferes with the normal operation of the Platform.
The GPT-HQ name, logo, website design, and platform code are owned by GPT-HQ and protected by intellectual property law. You retain ownership of content you create and list on the Platform. By listing content you grant GPT-HQ a limited, non-exclusive, royalty-free license to display, promote, and market your listings on the Platform and in related marketing materials. You may remove your listings at any time, which terminates this license for new uses.
Buyer payments are processed securely via Stripe. Seller subscription fees are charged as listed on the pricing page. GPT-HQ reserves the right to change fees with 30 days' notice. Continued use of the Platform after a fee change constitutes acceptance of the new fees. Taxes are the responsibility of the respective buyer or seller.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GPT-HQ DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPT-HQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE PLATFORM OR ANY PRODUCTS PURCHASED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID GPT-HQ IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
Any dispute arising from these Terms or your use of the Platform will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes will be settled by binding arbitration under the rules of the American Arbitration Association (AAA) on an individual basis. You waive any right to a class-action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court.
GPT-HQ may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or for any other reason with reasonable notice. You may close your account at any time by contacting support@gpt-hq.com. Upon termination, your right to access the Platform ceases; sections that by their nature survive termination will continue to apply.
These Terms are governed by the laws of the United States. To the extent not covered by arbitration, you consent to exclusive jurisdiction in the federal and state courts located in the United States.
We may update these Terms from time to time. When we do, we will update the Effective Date at the top of this page and, where changes are material, notify you by email or in-app notice. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
